An Overview of Bankruptcy

Chapter 7 is often filed by people who simply cannot afford to pay their bills and need relief from credit card debt, medical bills, and other debt to enable payment of their required monthly bills.  A Trustee helps to oversee the process and many of our clients are found to be "no asset" cases meaning that assets are retained and debt is forgiven.  An attorney can best help you to determine if Chapter 7 will be a good option for your financial situations.

Chapter 13 is most often filed by people facing foreclosure or repossession, though there are other situations that may lead to a Chapter 13 being a better fit for a particular client.  Chapter 13 allows debt to be restructured through a payment plan allowing repayment of debts over a period of time and often forgiving some portion of certain types of debt.  An attorney can look at your specific situation to give an idea of what payment may be necessary to gain approval of the Court in a Chapter 13 case.
